| Online Casino to Fight German Gambling Ban |

The boss of UK betting company MyLotto24.com, Carsten Frein, has announced that top lawyers have confirmed that the German ban on online gambling is unconstitutional under both German and European Union law. “We consider the state treaty on gambling as clearly illegal and will take legal action if necessary,” said Frein, echoing the views of parent company Tipp24. 'Reports by notable constitutional lawyers such as Professor Bodo Pieroth or Professor Hermes confirm that the treaty contravenes the German constitution and European law. The European Union and the German Monopolies Commission have also taken up a clear stance in this sense.” Frein’s comments come as criticism and threats of international litigation mount against the 16 German states that passed the ban, which prohibits online gambling from last Tuesday while introducing Internet freedom-sensitive rules. Operators Bwin and Fluxx have also criticised the accord and threatened to fight it in court. Frein also stated that there would be no impact to the UK side of the business but that, in Germany, the company was restricted in its ‘marketing communications’ until a resolution is reached in court.
